The Privacy Statement ("Statement") below refers to the personal information we collect from our websites and mobile applications (the "Site"), and the ways in which we collect and use it. The terms "we", "us", "Power1K", and "P1K" refer to P1K Fitness, LLC.
Account information. Note - Your account information can be changed at any time by following the Login link on the site. When you create an account on the site, we ask for and store such information as your name, email address, signup location, demographic, education, preferences, health and fitness information, etc. It is also possible to import your account information from a third party in order to make the Power1K registration process easier. Your name is used to create your Power1K member name, (which consists of your first and last name), and your signup location is used to help the Site give you the most relevant information and advertising to the town you live in. Your email address is used to provide certain services to you as it pertains to the Site, send you updates and to contact you.
Location data. Power1K can provide helpful information based on your location. If you choose to send us your location in any way (such as by mobile device), that information may be stored and used to provide you with area based information and advertising. You may deactivate this feature at any time by either reinstalling the application or shutting down the GPS on your mobile device. The Site also provides the option of notifying other Power1K users where you are.
Public content. There are several ways to contribute to the Site. Some of these include participating in talk threads, message boards, blogs, emails, uploading photos & videos, and filling out your public profile. These additional contributions (your "Public Content"), may be stored, displayed to other users, and used for promotional purposes. Keep in mind that if you choose to add personally identifiable information in your Public Content, it can be viewed and used by others. We are not responsible for information you include in your Public Content.
Third party services. If you choose to do so, Power1K also allows you to access "third party" services like Facebook, LinkedIn and Twitter in order to share contents, your own Public Content, and upload information about whom you are connected with on these services to make it possible to connect with them on Power1K. At any time you may cancel this feature on my Account page. These third party services may also provide Power1K with information from your accounts in order to enhance your experience on the site.
Messaging. Power1K allows you to exchange messages with others through the Site. These messages may be stored in order to send them as well as allowing you to manage them. You may also be allowed to send information from Power1K to your phone via text message. For the sake of carrying out these requests, your phone number, your carrier, and the date and time that the message was processed may all be logged. Your carrier may charge you for texts that you receive.
Inviting friends. Power1K allows you to invite your friends to join by providing us with their contact information. Your friends' contact information may be stored by us in order to invite them to join and connect with you on the Site. They will however always have the opportunities to opt-out of getting further emails from Power1K.
Activity and log data. Information may automatically be stored by us related to your use of the Site, for instance your browser type, the pages that you view on the site, IP address, requested URL, referring URL, browser language, the date and time of your visit, and the phone numbers and names of the businesses that you call through the Site. This type of information is used to administer the Site and provide the best possible standard of service to you. This information may also be used for the purpose of making statistical analyses of the behavior and characteristics of our users in order to measure interest in and use of the several areas of the Site.
Data storage. Data is stored in the United States.
Cookies. Cookies are sent to your computer for the purpose of improving the quality of our service and unique identification of your browser. Note that "Cookies" refer to tiny pieces of information that websites send to your computer's hard drive throughout your viewing of the site. We may make use of both session cookies (these cookies are canceled once you close the browser) and persistent cookies (these cookies stay on your computer until you delete them). Your browser help file directions will instruct you as to how to delete Persistent cookies. Note that if you choose to disable cookies, some parts of the Site may not work correctly or at all. Our cookies are attached to your information, such as your name, email address, and password. Some of our business partners are enabled to use cookies in conjunction with your use of Power1K. We have no control over or access to the use of these cookies. These cookies gather information about your use of Power1K such as which pages you visited within the Site, where you are visiting from, and other sites you visit if those sites work with the same third party, but will not gather such information such as your name, email address, contact information or other personally identifiable information that presented alone would allow the third party to either identify or contact you.
Credit Card Purchases. Credit card information and billing will be stored if you purchase Power1K products and services online. Information collected this way will only be exchanged with third parties who perform jobs needed to complete the purchase transaction (such as fulfilling orders and processing credit card payments). When sensitive information such as a credit card number is entered on our order or registration forms, Power1K encrypts that information using secure socket layer (SSL) technology and we store credit card data at the payment processor.
Customer Support. At any time you should feel free to send us feedback, register a complaint, or make inquires about the site. Your communications, including any personal information you choose to include in them, may be stored so that we can effectively respond to you.
Administration. The information described above for routine administrative purposes, such as looking into abuses present on the Site, making responses to user inquiries, and applying and enforcing our Terms of Service and Statement.
Public Content. If you choose to write content for public view on Power1K, we may distribute such Public Information to a larger audience by exchanging it or parts of it with third parties so that they may publish it on their own platforms. We may include your account name and profile photo in order to credit you as the source of these contributions.
Aggregate information. Non-personal information may be shared by Power1K in the aggregate to third parties relating to user behavior that are in connection with prospective or actual business relationship with those third parties, such as content distributors and advertisers.
Third party service providers. Third parties may be used by Power1K to perform tracking and reporting functions, conduct quality assurance testing, provide technical and customer support, and perform payment processing and provide other services in connection with the Site. We may share information about you with these third parties in order for them to accomplish the services they are required to perform however they are not permitted to utilize your personal information for any other purposes other than to provide the services requested by you.
Third party advertising. Some of the ads on the site are provided by third parties. Power1K does not send any individualized personal information to these parties, however they may have access to information obtained by what you share with them yourself or cookies. Power1K will never share, sell, trade, or rent personally identifiable information with third parties for their direct marketing purposes.
Business transfers. Your information may be shared with any subsidiaries, parent companies, joint ventures, or other companies under a common control that we may have now or in the future. In this case Power1K will require them to honor this Statement. If another company essentially acquires our company or all or substantially all of our assets, that company will possess your information and will assume the rights and obligations with respect to that information as laid out in this Statement.
Investigations. We reserve the right to investigate abuses on the Site, as well as apply and enforce our Terms of Service and Statement. Power1K may disclose information about you to third parties if we believe that such disclosure is reasonably necessary to (a) enforce or apply our Terms of Service; (b) take action regarding suspected illegal activities; (c) comply with legal process and law enforcement instructions and orders, such as a statute, subpoena, search warrant, judicial proceeding, or other legal process served on us; or (d) protect our rights, reputation, and property, or that of our users, affiliates, or the public.
There may be links on the Site with which Power1K has no affiliation. Except as laid out in this document, Power1K does not share your personal information with these parties, and we are not responsible for their own privacy practices.
A number of tools are provided by Power1K to manage the use of your information on the Site. For a summary of these tools follow the Login link. Be aware that you may receive daily/weekly communications from us. Also keep in mind that despite any requests to close your account or your indicated email preferences, there may be times where we may still need to contact you as required by law or on legal matters, namely to inform you of any updates to this Statement or our Terms of Service.
Power1K adheres to generally accepted industry standards in order to protect the personal information transmitted to us, both during submission and once we receive it. Be aware however that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we do strive to use commercially acceptable methods to protect your personal information, we cannot guarantee that it will be absolutely secure.
Power1K is directed towards general audiences and is not intended for children under 13. Note that we do not knowingly gather personal information from children under 13. If you are informed that your child has provided us with personal information without your consent, please contact us at privacy@power1k.com. Also, if we become aware that a child under 13 has imparted personal information to us without parental consent we take steps to remove such information and delete the child's account.
We customize the advertisements that you see based upon: (i) the information that you knowingly provide us (e.g., age, gender, stated health, interests and other information in your profile); (ii) geographic location which we may determine through your IP address or from your mobile device; (iii) data we receive from third parties or (iv) your behavior on the Sites or Services (commonly referred to as "Behavioral Advertising").
